
Bookings are subject to these Terms and Conditions of Hire. By signing the Booking Form (the Agreement) you are entering into a contract with Danny Willis, acting as an Employment Agent for the reservation of the Artiste named in the Agreement, and agreeing to be bound by these Terms and Conditions. The Agreement also forms a contract between you and the Artiste, subject to the Terms and Conditions stated herewith.
A booking is only confirmed once we are in receipt of the Agreement, duly signed by the client, together with the agreed booking fee. Until that time the booking will be treated as an enquiry only and Danny Willis reserves the right to accept an alternative booking for the Artiste without notification.
The terms of this Agreement do not allow for cancellation other than by mutual consent of all parties and confirmed in writing. Cancellations by e-mail or telephone will not be accepted. Notice of cancellation will be acknowledged within 48 hours of receipt in writing. If you do not receive this acknowledgement do not assume the event has been cancelled unless contact has been made by us. A cancellation fee will be charged as follows should a cancellation occur, unless by prior agreement:-
Within 14 days of the event - the full agreed fee
Within 30 days of the event - 50% of the full agreed fee
Within 90 days of the event - 25% (the deposit) of the full agreed fee
The booking fee is non refundable under any circumstances unless agreed by Danny Willis. The balance of the total fee payable, due 14 days prior to the event date, can be made by sending a cheque payable to Danny Willis.
It is the legal responsibility of the client to comply with, and ensure that, current Health and Safety Regulations are in place and any place of performance is fit for the use intended. A safe,
Smoke and/or Haze machines can only be used with the prior consent of the venue management.
A minimum clear floor space is required of 2.5m (8ft) x 1.5m (5ft) deep with a head height of 2.5m (8ft) for functions booked to include lighting. A minimum of 2 x 13 amp standard
For our initial sound and lighting system, a minimum of 1 hour is required for rigging and a further one hour to dismantle and load the equipment. This must be taken into account when planning any arrangements. Additional set up time may be required should any special requests be made for a larger or more complex system or where direct access is not available between vehicle(s) and set up position.
In the unlikely event of the Artiste being unable to perform, Danny Willis will endeavour to arrange for a suitable act with similar equipment and experience to cover the performance for the same price.
The client must be aware that, whilst we carry back up equipment, the breakdown of any electrical equipment can be an unavoidable occurrence and is often outside our control. Every reasonable effort to rectify any such situation will be taken. In the extremely unlikely occurrence of a non-performance, or if a total failure occurs, a full refund will be made. In such circumstances, this will be the full extent of our liability.
The Client is responsible for the conduct of all persons attending the event whether those persons are invited or not. We do not take any responsibility for controlling rowdy behaviour or ejecting unwanted persons from the event.
Danny Willis and those employed by him have the right to perform in a safe environment and reserve the right to terminate the performance should any physical/verbal abuse or intimidating actions be made to him or the performing Artiste, venue staff, any of those persons present at the event, or if the safety of our equipment is compromised in any way. We also reserve the right to not initiate or continue the performance should there by any doubt that the security measures in place are sufficient to guarantee the safety of our operators or equipment. In the event of any of the above circumstances no refund will be made.
No other persons or performers may use any of the equipment provided without the prior consent of Danny Willis or those employed by him. If such consent is provided, the artiste must have full PLI cover and their equipment must have a current P.A.T. certificate.
If performance time in excess of that agreed is requested, this will be at the discretion of Danny Willis and the venue management, and an extra charge may be levied.
Any delayed set up time and subsequent delayed start time due to the over-run of any prior proceeding, or of any situation outside of our control, will not warrant an extension of the stated finishing time or any fee reduction. Such situations may include, but are not limited to, poor access, room clearing and dance floor preparation.
No refund or reduction in hire costs will be made should the entertainment provided by the disco be unable to continue due to any sound limitation or noise reduction device being present in the venue. These devices often completely preclude the playing of amplified music in the venue and Danny Willis or those employed by him must be notified in advance if such a unit is fitted and at what level the unit is set.
